My soon to be ex-wife said that if I tried to locate her or bothered her at work she'd file a restraining order against me. I'm not going to do any harm to her but I'd like to know where she is just out of curiosity. If she files a restraining order against me does Johnny Law come to the house and confiscate all of my firearms?

Don't know BUT, since you're past the niceties of marriage now, I'd beat her to the punch and file an order against her. She's been stalking you after all.

Thats a good question Jon, a friend is dealing with this also. A restraining order has been filed against him and he wanted to know if he will ever be able to purchase a weapon again. It really sucks when it gets to this ,

In Michigan if someone files a Personal Protection Order against you, you cannot possess or purchase firearms and I also think you cannot purchase a hunting license. They also notify your employer

I just looked up Kalifornia

California Code of Civil Procedure Section 527.9

If someone files a restraining order against you, you have 24 hours to surrender to law enforcement your firearms OR to sell them to a licensed firearms dealer. If you surrender them to local law enforcement, they can charge you a storage fee

Trying to get stuff in order and no $$ right now to do anything/go any where. It all went to try to save the house. I won't have anything until I get my share of her retirement.

Are you sure you are still entitled to get a share of her pension ? Is it documented anywhere ?

Talk to a lawyer and bail. Forget the house if you don't think you can realize a profit or short sell it quickly. I hear NV and AZ are nice, not sure where you'd want to go though.
Try to be reasonable with your ex, keep your emotions out of it, communicate via attorney only.

YES, and they did it to me for my brother inlaw filing one against me..

John, leave her alone and walk away. Don't talk to her use lawyers if needed and that is it. Pretend like she died and you cannot dig her up, its over. The law is not on your side in a case like this. Rick B

So a vindictive piece of crap cunt can file a restraing order against you, do it out of pure bitchiness and you will have to surrender and lose your right to own or purchase firearms?? thats BS and is just wrong,,

A guy can do it to you like I had and DogBoysDad helped me out. I almost lost everything for 5 years and only because he said so and filed. They said it was up to the courts to figure it out but all guns go until that happens. I told them for it too be fair both parties should lose them. Rick B

Jon, I'm not sure how it works where you live, but I have been in this situation. I have a CCW License and if you see me and I have pants on.....I'm armed. The day I left my second wife I told her I was leaving and I pulled my truck in the alley to clean out some junk, so I could load some of my things. While in the alley I hear sirens, being a firefighter it caught my attention so put my radio on scan. Guess what? Police are coming to me, cause supposedly I had just threatened my wife with a handgun. Yes I was wearing pants and had a fully loaded 357 mag and two speedloaders on me! They pulled up weapons out and demanded I "assume the position" which I gladly did because the barrel of a Glock 40 looks to be about 36" in diameter when you're looking into it! Officer asked if I was armed I told him yes and where my weapon was located, he removed my weapon and loaders placed them in his car and holstered his weapon. Meanwhile my wife was standing about 30 yds away laughing. Another officer went to her and she said "No he didnt pull a gun on me, but he has one and I felt threatened." So who knows where the story got twisted, dispatch or she lied. Anyway they went inside with me allowed me to get some clothes, toothbrush and razor and escorted me to the end of the block. The officer returned my weapon and ammo and strongly suggested I stay away from the house, and that I not carry concealed untill this was worked out. About a week later a Deputy showed up at my place of work and served me with a restraining order, which had a court date. I was to attend this and if found guilty of domestic violence or abuse YES I would have lost my right to carry own posses or use a firearm. Not to mention my job because it's a felony and you can't be a felon and work as a Firefighter! My first ex-wife went to bat for me and showed up to dispute allegations that I was violent or abusive, the lawyer for my second wife asked who she was and how long we were married she told him 17 years and that I'd never done any such thing during our marriage. He went to the judge and the restraining order was dropped without hearing.
So its a sad and serious thing, because Jon "you're guilty till proven innocent" where this stuff is concerned, but at least in Oklahoma they don't just show up at presentation of order and take all your weapons! Good Luck Brother! Best advice is Stay the hell away from her, don't talk to her don't even look in a direction you think she may be, and put off any weapon carrying / shooting for fun or otherwise till the thing is over!

I just reread the order that was against me and it reads........
Page #2 lines 8 & 9

#8 Possession of a firearm or ammunition by a Defendent while this Order is in effect, may subject the Defendant to prosecution for a violation of federal law even if this order does not specifically prohibit the Defendant from possessing a firearm or ammunition.
#9 This Order complies with the Violence Against Women Act's full faith and credit provision (18 U.S.C. 2265) and this Order is enforceable throughout Oklahoma and in all 50 states, U.S. territories, tribal lands and the Distract of Columbia.

The good thing ( in Oklahoma ) is it doesn't spell out what MUST be done with said weapons / ammo. It just says Defendant can't possess them. I sent my stuff to a friend's home during my 'lil circus!
