Personally I think the whole hate crime enhancer is Bull. A crime is a crime. They should all be treated the same, whether your black, white, red, purple, gay, straight, jew, gentile. Especially since it is selectively applied for political correctness.

They are talking an implied connection to this phrase without due process of law and applying it to the final clause. Actually I'd be curious if anyone has actually challenged a hate crime conviction / sentencing based on this defense. [Not a lawyer, too much self-respect]
